MEDIATION

“Mediation” is a condition set forth in your Insurance Policy to provide avenues of settlement when you have a dispute on the amount of damages to your property.

Florida Statute 627.7015 Rule 4-166.031 mandates that all property and casualty companies are required to make available to their insureds, the opportunity for “Mediation” on first party property insurance claims when there is a disagreement on the amount of damages. Commercial and automobile coverage are excluded. The cost of “Mediation” is paid by the Insurance Company.

A Mediator is appointed to act as a go between. The mediator is impartial to either side. The mediator relays information between both parties and points out the weaknesses and strengths of each side to obtain a compromise that everyone can be happy with.

“Mediation” is not binding unless you and your insurance company reach an agreement. That means if you both do not agree to the final dollar amount offered, then the claim can proceed either to Court or “Appraisal”.

You are not required to attend “Mediation” in order to proceed with “Appraisal”.
